These Terms of Service ("Terms") govern the access and use of the dallaterra.it website and the purchase of products offered by Davide Motta, private citizen, with address at Calle Moderna 12, Ático 4, Barcelona, Spain. By using the Website or making a purchase, the user fully accepts these Terms.
To make purchases on the Website, you must be at least 18 years old. By placing an order, the user declares to meet this requirement.
All products are handcrafted in Florence, Italy. Availability is limited and not guaranteed until order confirmation. Prices are expressed in Euro (€) and include all applicable taxes, unless explicitly stated otherwise. The Seller reserves the right to change prices at any time, without prior notice, it being understood that the price applied will be that indicated at the time of order confirmation.
The order is completed with email confirmation by the Seller. The Seller reserves the right to refuse orders in case of: product unavailability, pricing errors, suspected fraud. In such cases, any amount charged will be fully refunded within 5 business days.
Payments are managed by Stripe Inc. (PCI-DSS Level 1). We accept: credit/debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay. Payment is required at the time of order. In case of non-payment, the order is automatically cancelled.
We ship throughout Europe and to major international markets. Estimated delivery times are: Italy 2-4 business days, Europe 4-7 business days, Rest of the world 7-14 business days. Delivery times are indicative and may vary. The Seller is not responsible for delays caused by couriers, customs or force majeure events.
Pursuant to Directive 2011/83/EU, consumers residing in the European Union have the right to withdraw from the contract within 14 days of receiving the product, without needing to provide any reason. To exercise the right of withdrawal, send written communication to [email protected] within the specified period. The product must be returned in original condition, unworn and in its original packaging. Return shipping costs are borne by the Customer, unless otherwise agreed. The refund will be made within 14 days of receiving the returned product.
Products made to measure or personalized at the Customer's request are excluded from the right of withdrawal pursuant to art. 59, letter c) of Legislative Decree 206/2005.
Products are covered by the legal guarantee of conformity provided by applicable law (2 years for EU consumers). In case of conformity defects, the Customer has the right to repair or replace the product, or alternatively to a price reduction or termination of the contract.
The Seller is not liable for indirect, incidental or consequential damages arising from the use of the Website or the purchase of the Products, within the limits permitted by applicable law.
These Terms are governed by Spanish law. For disputes with consumers, the consumer protection rules of the consumer's country of residence apply. For disputes between professionals, the competent court is that of Barcelona (Spain).
The Seller reserves the right to modify these Terms at any time. Changes will be published on the Website and will be effective from the date of publication. Continued use of the Website after the publication of changes constitutes acceptance of the new Terms.
